Terms of Service

These terms govern your use of the NextSend mobile app (“App”) and the website at nextsend.app. By using the App you agree to these terms and to our Privacy Policy.

1. Agreement and the service

NextSend provides an offline-capable climbing guide (crags, sectors, routes, topos) and an optional personal logbook for signed-in users. Sign-in, maps, analytics, and hosting may involve third parties (for example Google or Esri) under their own terms. We may change, suspend, or discontinue features at any time.

If you obtained the App from the Apple App Store, you acknowledge that these terms are between you and NextSend, not Apple, and that Apple has no obligation to provide maintenance or support for the App.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age in your country) to use the App. You are responsible for ensuring climbing and outdoor activities you undertake are lawful and appropriate for your skill level.

Account features require a valid sign-in. Keep your credentials secure; you are responsible for activity under your account. You may delete your account at any time from Profile → Delete Account. We may suspend or terminate access if you breach these terms.

3. Climbing and safety

Outdoor climbing is dangerous. The guide, topos, grades, bolt counts, access information, and other content are for general information only. Conditions change; information may be incomplete or incorrect. Always verify routes, anchors, and access on site. You climb and use the App at your own risk. NextSend does not provide professional instruction, supervision, or safety guarantees.

4. Content and acceptable use

Guide data, images, topos, branding, and software are owned by NextSend or its licensors. You may use the App for personal, non-commercial climbing. You may not copy, scrape, redistribute, or commercially exploit the guide content without permission.

Ascents, notes, ratings, and other logbook entries you create are your content. You grant NextSend a limited licence to store and show that content back to you in the App. Logbook entries are private in the current version. If you import climbs from another service (for example theCrag or 8a.nu), you are responsible for having the right to import that data and for its accuracy. Do not submit unlawful or abusive content.

You agree not to:

• Abuse, disrupt, or attempt to breach the App or our API
• Impersonate others or use the service for spam or fraud
• Reverse engineer the App except where law permits

5. Disclaimers and liability

The App and content are provided “as is” without warranties of accuracy, availability, or fitness for a particular purpose, to the fullest extent permitted by law.

To the fullest extent permitted by law, NextSend is not liable for indirect or consequential damages, or for injury, death, or loss arising from climbing or reliance on guide information. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the twelve months before the claim (or zero if the App is free). Nothing in these terms limits rights that cannot be excluded under applicable consumer law.

6. Law, contact, and changes

On account deletion, your stored account and logbook data are removed as described in the Privacy Policy.

These terms are governed by the laws of Portugal, without regard to conflict-of-law rules. Courts in Portugal have exclusive jurisdiction, unless mandatory consumer protection laws in your country give you different rights.

We may update these terms and will change the “Last updated” date when we do. Material changes may be communicated in the App or on this site. Continued use after changes means you accept the updated terms.
